Personal data may be transferred to a recipient in the USA if special guarantees are provided for an adequate level of data protection. Such guarantees can be seen above all in the conclusion of so-called EU standard contractual clauses, the existence of binding internal data protection regulations (Binding Corporate Rules) at the recipient company or in a decision by the European Commission confirming the recipient’s compliance with an appropriate data protection standard.
